What’s the difference between a “training contract” and a “trainee solicitor employment contract”?
In current SRA terminology, a “training contract” refers to the formal training arrangement under which a person undertakes qualifying work experience to become a solicitor — it is the regulatory framework. A “trainee solicitor employment contract” is the underlying employment contract between the firm and the trainee, which sits alongside the regulatory training arrangement. Both are required. The employment contract governs salary, hours, holiday, duties, confidentiality, restrictive covenants, and termination — the day-to-day relationship between the firm and the trainee. Our contract is the employment contract, and it cross-references the training arrangement (and any separate Training Costs Agreement) at the relevant points.
Does this contract cover SQE qualifying work experience (QWE)?
Yes. The contract is drafted for use with both the traditional training contract route (where it still applies) and the SQE route requiring qualifying work experience. Clause 13 of the contract expressly addresses QWE: it requires the Firm to use reasonable endeavours to provide the range and breadth of experience required to develop the SRA’s Statement of Solicitor Competence, arranges for a suitably qualified solicitor or COLP to confirm QWE when required, and confirms that the Firm’s ability to confirm QWE is conditional on the trainee’s satisfactory performance and SRA compliance. This is a feature that most legacy trainee contract templates have not yet been updated to reflect.

Does the contract include a training costs clawback clause, and do I need a separate Training Agreement?
The contract addresses Training Costs at clauses 13.3 to 13.5 and requires any Firm funding of training costs to be governed by a separate written Training Agreement. We recommend a separate Training Agreement (rather than a clawback clause in the main contract) because case law strongly favours this structure for enforceability — clawback obligations buried inside an employment contract are at higher risk of being treated as unlawful penalties or unlawful deductions of wages.
